What To Do After a Denied Claim
SSD/SSI benefits are granted if you lack the residual functional capacity to perform your past work or other substantial gainful activity. People over age 50 who are unable to do their past job may qualify for benefits even if they could do a different job, however.
If you receive a denial after your initial application, you must apply for reconsideration within 60 days. I can help strengthen your application by including the necessary medical reports and other information.
If you are turned down after reconsideration, you have 60 days to request a disability hearing before an administrative law judge. The judge will have no prior knowledge of your case, so your file must include all of the necessary information. I will work with you to prepare for the hearing and will be there to represent you as well.
People who receive a denial after the hearing may choose to appeal the decision in federal court.
